Terms of Service
These Terms govern your use of CinderTutor, an online tutoring service operated by CinderTutor Pty Ltd (ACN 471 836 204), an Australian proprietary limited company (“CinderTutor”, “we”, “us”). By creating an account or booking a lesson you (“Parent” or “Customer”) agree to these Terms on behalf of yourself and the student or students you enrol.
01 Acceptance
You accept these Terms by creating an account, booking a trial lesson, or otherwise using the Service. If you accept on behalf of a school or organisation, you represent that you have authority to do so.
02 The service
CinderTutor provides 1-on-1 online tutoring sessions with subject-specialist tutors, supporting materials (lesson notes, session recordings, weekly progress reports), and a parent dashboard. The available subjects, year levels, tutor pool, and supported curricula (HSC, NCEA, IB, and others as listed) may change over time.
03 Accounts & minors
The Parent is the account holder. A parent or legal guardian must create the account on behalf of any student under the age of 18. We do not accept account creation by users under 18 acting on their own behalf.
You are responsible for keeping your account credentials secure and for any activity under your account. Notify us at security@cindertutor.com if you suspect unauthorised access.
04 Acceptable use
You and any student under your account must not use the Service to:
- send unsolicited communication to tutors outside of session contexts;
- attempt to recruit a tutor for direct private engagement outside the platform, except by mutual written agreement with both us and the tutor;
- record sessions independently (we provide platform recordings for review);
- share session recordings or tutor materials publicly or with non-account users;
- attempt to gain unauthorised access to other accounts or platform systems.
05 Sessions & recordings
Sessions are 50 minutes by default unless otherwise booked. All sessions are video-recorded by default for educational continuity and parent supervision; the recording is visible only to the parent account holder and the tutor. You can request that recording be disabled for specific sessions in advance.
Cancellations made more than 24 hours before a session restore the session to your monthly allowance. Cancellations within 24 hours forfeit the session unless waived by us (typically for illness or emergency).
06 Fees & cancellation
Plans are billed monthly in advance to the payment method you provide. Prices are listed at /pricing and are inclusive of GST for Australian customers. You may cancel from the parent dashboard at any time; cancellation takes effect at the end of the current billing month. Banked unused sessions remain available for 6 months from your last billed month.
07 Refunds
If you are not satisfied with a matched tutor within your first paid month, contact us within 30 days and we will refund that month in full and either rematch you or end your account. After the first month, you may cancel at any time; we do not pro-rate refunds for partial months but we also do not charge another month after cancellation.
Nothing in this section limits any rights you have as a consumer under the Australian Consumer Law.
08 Tutors
Tutors are contractors of CinderTutor, not your direct employees. We are responsible for tutor vetting, training, and conduct. If you wish to continue privately with a tutor independent of CinderTutor, both we and the tutor must agree in writing — a 90-day non-circumvention period applies from the most recent session of the tutor with your child.
09 Liability
To the maximum extent permitted by law, we exclude liability for indirect, incidental, or consequential damages. Our total aggregate liability arising from or related to these Terms in any 12-month period is limited to the amounts paid by you to us in that period. Nothing in these Terms excludes liability that cannot be excluded under Australian law, including under the Australian Consumer Law.
10 Governing law
These Terms are governed by the laws of South Australia, Australia. Disputes will be heard in the courts of South Australia, except where mandatory consumer-protection rules in your jurisdiction provide otherwise. We are participating members of the eCommerce code of conduct.
11 Changes
We may update these Terms. Material changes will be communicated by email to the account holder at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
